These Terms and Conditions (“Terms”) govern your access to and use of the Kaefôur Brands website, including any purchases, features, content, tools, and services made available through www.kaefour.com (the “Site”). Throughout these Terms, “Kaefôur Brands,” “we,” “us,” and “our” refer to Kaefôur Brands.

By accessing or using the Site, or by purchasing products from us, you agree to be bound by these Terms and our related policies referenced on the Site, including our Privacy Policy, Shipping Policy, and Returns Policy. If you do not agree to these Terms, please do not use the Site.

1. Eligibility and Use of the Site

After you place an order, you may receive an order confirmation email. That email confirms that we received your order request, but it does not guarantee acceptance. We reserve the right to accept, reject, or cancel any order before shipment.

3. Pricing, Product Information, and Availability

We strive to describe and display our products as accurately as possible, including product images, pricing, availability, ingredients, sizes, and promotional details. However, the Site may occasionally contain typographical errors, inaccuracies, omissions, or outdated information. We do not guarantee that all content is complete, current, or error-free.

Prices, promotions, shipping rates, and product availability are subject to change without notice. We reserve the right to correct errors and update information at any time, including after an order has been submitted. If a material error affects your order, we may cancel the order and notify you.

If we suspect that an order is inaccurate, fraudulent, unauthorized, or placed for resale in violation of our policies, we may delay, limit, reject, or cancel the order.

Your use of those services may also be subject to the separate terms and privacy policies of those providers. Kaefôur Brands is not responsible for the independent acts or omissions of third-party providers except as required by law.

6. Shipping, Delivery, and Risk of Loss

Shipping timeframes are estimates only unless expressly stated otherwise. Actual delivery times may vary because of carrier delays, weather, holidays, address issues, product availability, or other factors outside our reasonable control. Risk of loss and title for physical goods generally pass in accordance with the applicable shipping method and carrier process, subject to applicable consumer-protection law.

7. Returns, Exchanges, and Refunds

Returns, exchanges, store credits, and refunds are governed by our posted Returns Policy. We reserve the right to deny returns or refunds that do not comply with that policy, subject to applicable law.

8. Intellectual Property

All content on the Site, including text, images, graphics, product names, logos, branding, page design, icons, videos, downloads, code, and other materials, is owned by or licensed to Kaefôur Brands and is protected by applicable intellectual property and unfair competition laws.

You represent that you own or control the rights necessary to provide the submission and that your submission does not violate any law or third-party rights. We may remove or decline to post submissions at our discretion.

Promotions, discount codes, giveaways, bundles, free-shipping offers, and similar offers are subject to their stated terms and may be modified or discontinued at any time unless prohibited by law. Promotions may not be combined unless expressly stated.

16. Limitation of Liability

To the fullest extent permitted by law, Kaefôur Brands and its owners, officers, employees, contractors, affiliates, suppliers, service providers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, use, data, savings, or business opportunities, arising out of or related to your use of the Site, your inability to use the Site, any purchase made through the Site, or any content, product, or service offered through the Site, even if advised of the possibility of such damages.

To the fullest extent permitted by law, our aggregate liability for any claim arising out of or relating to the Site or any purchase through the Site will not exceed the amount you paid to Kaefôur Brands for the specific product or service giving rise to the claim, or one hundred U.S. dollars (US $100), whichever is greater, unless a different amount is required by applicable law.

17. Indemnification

You agree to defend, indemnify, and hold harmless Kaefôur Brands and its owners, officers, employees, affiliates, contractors, service providers, licensors, and suppliers from and against any claims, liabilities, damages, judgments, losses, costs, expenses, or fees, including reasonable attorneys’ fees, arising out of or related to your violation of these Terms, your misuse of the Site, your submissions, or your violation of any law or third-party rights.

18. Termination

We may suspend or terminate your access to the Site or any part of it at any time, with or without notice, if we believe you have violated these Terms, engaged in fraud or abuse, created risk or possible legal exposure for us, or if we otherwise determine that suspension or termination is appropriate. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, indemnification, governing law, and dispute-related provisions.

19. Governing Law

These Terms and any dispute arising out of or relating to the Site or our products or services will be governed by and construed in accordance with the laws of the State of Missouri, without regard to conflict-of-law principles, except to the extent superseded by applicable federal law.

20. Dispute Resolution

Before filing a legal claim, you agree to contact us first and make a good-faith effort to resolve the dispute informally. If a dispute cannot be resolved informally, any legal action shall be brought in a court of competent jurisdiction located in Missouri, unless applicable law requires otherwise.

21. Force Majeure

Kaefôur Brands will not be liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, severe weather, fire, flood, labor disputes, power or internet outages, carrier disruptions, public-health events, governmental actions, cyber incidents, supply-chain interruptions, or other force majeure events.

22. Severability

If any provision of these Terms is held unlawful, invalid, or unenforceable, that provision will be enforced to the fullest extent permitted by law and the remaining provisions will remain in full force and effect.

23. No Waiver

Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of that right or provision.

24. Entire Agreement

These Terms, together with any policies or rules posted by us on the Site and incorporated by reference, constitute the entire agreement between you and Kaefôur Brands regarding your use of the Site and supersede prior or contemporaneous understandings relating to that subject matter.

25. Changes to These Terms

We may update these Terms from time to time by posting the revised version on this page and updating the “Last Updated” date. Your continued use of the Site after revised Terms are posted constitutes your acceptance of the updated Terms, to the extent permitted by law.
